In pre-arbitration discussion of H8C-NA-C 50 it was mutually agreed that the following would represent a full settlement
of the case:

1. No former full-time regular shall be reemployed as an unassigned regular where a residual vacancy exists and the employee's physical condition would not prohibit the employee from fulfilling the duties of the residual vacancy in question.
2. A former full-time regular employee reemployed under 546.212 of the Employee and Labor Relations manual as an unassigned regular shall be placed into the first residual vacancy that the employee is physically capable of performing, unless that employee is deemed the successful bidder for another position.
3. Former part-time flexible employees who accept reemployment may be returned to part-time flexible status unless there is a residual vacancy that they are physically capable of performing and their seniority is greater than the junior full-time regular on the rolls, in which case they are eligible for vacancies subject to the limitations in 2 above.
4. Former employees reemployed under 546.212 of the Employee and Labor Relations Manual into full-time duty assignments are entitled to bid on vacant craft duty assignments under the terms and conditions of the National Agreement.
