The question raised in this grievance is whether management was proper in placing the grievant in an unscheduled leave restriction status. After further review of this matter, we mutually agreed that no national interpretive issue is fairly presented in the particulars evidenced in this case. Whether or not the employee was properly placed in a restricted sick leave status can only be determined by applying ELM 513.371 to the actual fact circumstances. However, nothing in the above reference of the Employee and Labor Relations Manual provides for the establishment of an "unscheduled leave restriction" list. Accordingly, as we further agreed, this case is hereby remanded to the parties at Step 3 for further processing, if necessary.
