The question in this grievance is whether management's letter requesting information regarding the status of a third party tort claim was threatening. During our discussion, it was mutually agreed that the following would represent a full settlement of this case:
An employee's cooperation in assisting the U.S. Postal Service in pursuing a tort claim against a third party is voluntary. Therefore, the subject letter, as currently written, must be rescinded with regard to all employees involved in a third party tort claim. Additionally, the letter shall be removed from the grievant's personnel file.
