The issue in this grievance is whether the local policy regarding postal supervisors accompanying employees to medical facilities or physicians' offices after an on-the-job injury in non-emergency situations, violated ELM 543.222. After receiving this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. There is no dispute between the parties at this level concerning the meaning and intent of ELM 543.222. Consistent with ELM 543.222, a postal supervisor is not authorized to accompany an employee to a medical facility or physician's office in non-emergency situations, other than the USPS medical unit. The parties further agree that an employee is not required to seek or accept treatment at the USPS medical unit. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing consistent with the above.
