The issue in this grievance is whether local management violated the provisions of Article 19 by the assignment of three key hits to the firm holdouts on the MPLSM. After further review of the matter, we mutually agreed that there was no national interpretive issue fairly presented as to the meaning and intent of Articles 37 and 19 of the National Agreement. The determination of whether management's actions were proper can only be made by application of Section 310 of the M-54 to the specific facts in this case. Accordingly, as we further agreed, this case is hereby remanded to Step 3 for further development and consideration, if necessary, by the parties.
