The question in this grievance is whether management violated Article 19 of the National Agreement; specifically Handbook M-16, as it relates to EDIT samples. The union contends that the grievant was the next LSM operator to be tested and was improperly passed over. After further review of this matter, we mutually agreed that no national interpretive issue is fairly presented in the particulars evidenced in this case. There is no dispute between the parties at the national level concerning the meaning and intent of Part 220, M-16. We agreed that under certain circumstances LSM operators may be passed over for a particular EDIT check. An employee properly assigned sweeper-tyer duties for a lengthy period on a particular day could be one of these instances. In such cases, the random selection process is not adversely impacted. Accordingly, based upon our mutual understanding, this grievance is resolved
