The issue in this grievance is whether the grievant' s EDIT was properly conducted and recorded. After further review of the matter, we mutually agreed that there was no National interpretive issue fairly presented as to the meaning and intent of Article 37 ot the National Agreement. The issue in this case will be resolved by a determination of facts and their subsequent application to the M-16 EDIT Handbook. The major fact to be determined is whether the grievant was at the cited consoled when the EDIT was conducted. Accordingly, as we further agreed, this case is hereby remanded to Step 3 for further development and consideration if necessary by the parties.
