The issue in this grievance is whether Level 6 MPE Mechanics who are assigned to MPLSM overhaul teams should be paid at the Level 8 rate. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. We agreed that if the employees perform higher level duties, they are entitled to higher level pay. We also agreed that this can only be determined based on the facts involved. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing including arbitration if necessary.
