The issue in this grievance is whether a light duty employee is entitled to higher level pay when performing higher level duties in a light duty assignment. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly represented in this case. We agreed that it is necessary to determine whether the grievant performed duties which would qualify for higher level pay. This determination is to be made based on the specific work performed by the grievant. This case is remanded for application of Article 25, which provides higher level pay for higher level work. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
