The issue in this grievance is whether the grievant was properly required to repay monies overpaid due to an error in computing Social Security/retirement funds. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. This is a local dispute suitable for regional determination by application of Article 28 of the National Agreement to the fact circumstances. The parties at this level agreed that Section 4 of Article 28 only applies to Sections 1, 2 and 3 of that Article. Further, upon an employee's request for Form 3074, Request for a Waiver of Claim for Erroneous Payment of Pay, such form will be provided. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing including arbitration, if necessary.
