The question in this grievance is whether or not management violated Article 33 of the National Agreement by not selecting the grievant for a vacant Clerk, Vehicle Dispatching, position. During our discussion, we agreed that the position was posted in accord with Article 39 and ELM provisions. Therefore, the only remaining issue is whether the grievant, in competition, without craft priority and against all career employees at the office was best qualified for the position. We agreed that this remaining issue is not a National interpretive question. Accordingly, the case is remanded to the parties at Step 3 for further processing if necessary.
