As discussed, this is to confirm our understanding that, in those situations when a PS-4 clerk bids a PS-5, PS-6 or PS-7 clerk assignment pursuant to Article 37.3.A.10.a(4) of the National Agreement, and when a PS-4 clerk and a PS-5, PS-6 or PS-7 clerk are the senior bidders with the same seniority ·dates, ties will be broken using the provisions of Article 37.2.D.4. If those provisions fail to break the tie, then the PS-4 clerk will be considered junior.
