The question raised in this grievance involved the establishment of seniority when an employee returns to a senior qualified position from a best qualified position. The grievant claims he should be allowed to bid from a position he was awarded on the basis of best qualified to a senior qualified position using the current date as his seniority date. During our discussion, we agreed to settle this case based on our understanding of Article 37.3.F.11 which provides, in part, that a clerical employee in a best qualified position (PS-5) may bid and complete for senior qualified positions in PS-5 and PS-6, utilizing the seniority the employee had at the time of promotion to the best position. Inasmuch as the record shows that the foregoing provision was properly applied in this case, we agreed that no further action is necessary.
