The question in this grievance is whether management violated Article 37 of the National Agreement by not including credit for the period October 31, 1959 - December 26, 1969, in establishing the grievant's seniority date upon his return to the clerk craft. In this case, the grievant's assignments were as follows:

10/31/59 - 12/26/69 - Clerk Craft
12/27/69 - 10/31/80 - Supervisor
11/1/80 - 7/14/81 - Carrier
7/15/81 - Present - Clerk

After further review of this matter, we agreed that no national interpretive issue involving the terms and conditions of the National Agreement is fairly presented in this case. The question raised requires application of Article 37.2.D.8.a.(.2), rather than interpretation. Accordingly, as we further agreed, this case is hereby remanded to the parties at Step 3 for further processing, if necessary.
