The issue in this grievance is whether the grievant received proper seniority credit and the appropriate salary rate when reemployed after a disability separation. After further review of this matter, we agreed that there was no national interpretive issue fairly presented as to the meaning and intent of Article 37 of the National Agreement. During our discussion, we agreed that the parties at Step 3 should apply Article 37, Section 2.D.7, and Arbitrator Aaron's National Award in case 38C-4A-C 11834 to the specific fact circumstances involved. Accordingly, we agreed to remand this case to Step 3 for further consideration by the parties.
