We mutually agreed that there was no interpretive dispute between the parties at the National level as to the meaning and intent of Article 37 of the National Agreement as it relates to posting of preferred duty assignments in this case. According to the file, on March 23, 1982, a position in this local office was posted for bid which included the duties of caller service window and postage due. The local union contends that postage due is presently a level 6 assignment and should be filled by a senior qualified clerk. They also contend that these duties are not designated as principal assignment areas ,in accordance with the local Memorandum of Understanding. The parties at the National level have determined, from a review of the file, that the position is not a new position, it is the same position that was vacated by an incumbent and reposted with a minor change. The postage due function, however, was retained. The parties also noted that the disputed duties were listed as relief duties, not as principal assignments. Whether or not a violation of, or condition of the LMOU occurred is a matter to be determined at the lower level. Accordingly, as further agreed, this case is hereby remanded back to Step 3 for further processing by the parties at that level.
