The issues in this grievance are whether (1) part-time PSDS relief Data Collection employees work less than 50% in that capacity, and (2) whether these positions were properly posted. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. This is a local dispute suitable for regional determination by application of Section 233.4 of the Employee, Labor Relations Manual to the fact eireunustances. Once that determination has been made the second issue may be determined by application of Article 37, Section 3(A) of the National Agreement to the involved fact circumstances. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
