The question in this grievance is whether or not management violated Article 37 of the National Agreement by its manner of posting Relief Data Collection Technician positions. The Union contends that such postings also violate a regional policy established in 1977. According to the file, local management has established these relief positions, at permanent level 6, to be used as needed in the Data Collection Unit. When hot needed, they are assigned other duties and continue to be paid at the higher level. The issue in 1977 concerned Relief Data Collection positions which were established at permanent level 5, to be filled on a best qualified basis. Such positions were considered improper and were rescinded. In our opinion, the positions may properly be posted as permanent level 6 best qualified positions under the circumstances discussed in this grievance. Accordingly, as we find no violation of the National Agreement, this grievance is denied.
