The question in this grievance is whether management violates Article 37 by not posting a notice of reversion, advising of the action taken and the reasons therefor, within 21 days from the time a position becomes vacant. During our discussion, we agreed that there is no contractual requirement to post a vacant duty assignment, which is to be reverted, within 21 days. However, management recognizes its contractual obligation pursuant to Article 37.3.A.2 that when a vacant position is under consideration for reversion, the local Union President will be given an opportunity for input prior to a decision. The decision to revert or not to revert the position shall be made not later than 21 days after it becomes vacant. If the vacant assignment is reverted, a notice shall be posted advising of the action taken and the reasons therefor within a reasonable period of time after the decision to revert has been reached.
