The issue in this grievance is whether an employee was detailed to a supervisory position in excess of four months. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. We agreed that a determination in this matter can only be made based on the local fact circumstances. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing including arbitration if necessary. A review of EL-202, Initial Level Supervisory Positions, should be made in further processing.
