The issue in this grievance is whether a 204-B can apply for a Best-Qualified Position. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. We further agreed that there is no dispute with the meaning or intent of Article 37, Section 3(A)(7) of the National Agreement at this level. Whether the 204-B was the best qualified applicant can be determined based on the fact circumstances in this case. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
