the issue in this grievance is whether management violated the National Agreement by not placing the next senior qualified bidder in subject job within the prescribed time. After further review of this matter, we agreed that there is no national interpretive issue fairly presented in this case. This is a factual dispute over the application of Article 37, Section 3.F(2). The parties at this level agree that once the "then qualified" employee is selected, that employee becomes the successful bidder. In accordance with Article 37.3.F(2), such employee is placed in the new assignment within 21 days unless the local agreement sets a shorter period. Accordingly, we agreed to remand this case to Step 3 for further consideration by the parties.
