Arbitrator Eischen determined that Article 16.6 of the NRLC CBA was violated if there is a "command decision" from higher authority or a joint decision by the initiating and reviewing officials to impose discipline. The Arbitrator also found that the failure of either the initiating or reviewing official to make an independent and substantive review of the evidence prior to imposing discipline or lack of evidence of written review and concurrence violated the CBA. {NOTE: This is an NRLC award. Close examination and comparison of Article 16.8 in the APWU CBA to the language of Article 16.6 in the NRLC CBA is essential.]
