Casual Compliance Reports

Casual Compliance Reports are provided to the union on an accounting-period basis so that the APWU can monitor management’s adherence to Article 7.1.B. of the National Agreement. These reports are listed in reverse chronological order, i.e., the most recent report is at the top.

The Casual Limits

New provisions of Article 7.1.B of the 2006-2010 Collective Bargaining Agreement limit the number of casuals that may be employed within a District and within an installation in any accounting period, except accounting periods 3 and 4. Casuals employed in a District shall not exceed 6 percent of the total number of career employees within the District (except for accounting periods 3 and 4). Within this 6 percent District casual cap, the number of casual employees in any postal installation of 200-man years or more shall not exceed 11 percent of the total number of career Clerk Craft employees in that installation (except for accounting periods 3 and 4).

The Compliance Reports

There are two compliance reports: The 200 Man-Year APWU Clerk Casual Compliance Reportused to monitor compliance with the 11-percent limit on casuals in an installation. The APWU District (Performance Cluster) Casual Compliance Report used to monitor compliance with the 6-percent limit on casuals in a District.

For the 200 Man-Year APWU Clerk Casual Compliance Report, all of the counts and percentages are limited to the Clerk Craft complement. The report calculates the allowable number of casuals, compares it to the actual number, and shows the number of casuals currently “Over/Under” the limit.

For the APWU District (Performance Cluster) Casual Compliance Report, the counts and percentages represent all APWU craft employees. The column labeled “Casual On-Roll Limit” shows the 6% limit for the particular District. The report calculates the allowable number of casuals, compares it to the "Actual Casuals On-Rolls" number, and shows the number of casuals currently “Over/Under” the limit.

(Please note that these reports indicate the Pay Period from which the numbers were collected, but the report covers the corresponding Accounting Period.)

Violations and Disputes

Disputes concerning violations of the casual cap are addressed by the parties at the national level. The APWU national office will monitor adherence to the 6-percent-per-District limit and 11-percent-per-installation limit and, if necessary, initiate the appropriate discussion and action for remedy. Where violations occur, it should not be necessary to initiate disputes, as the remedy for such violations is specified in the contract.

However, locals are also advised to monitor compliance with the 11-percent limit per installation, and, where necessary, to initiate the appropriate communication with local management. If a dispute arises or local grievances are filed over the number of casual employees management has reported, the APWU national office should be contacted. (Any documentation and supporting data should also be provided.)

Pursuant to Article 7.1.B.3.a of the Collective Bargaining Agreement, if the Postal Service exceeds the limitations on the number of casuals that may be employed, the District or Installation “shall reduce their casual workforce by the total number of casuals exceeding the 6 percent or 11 percent cap within two accounting periods from when the violation took place, except that such reductions will not occur in accounting periods 3 and 4. The casual reduction associated with a violation occurring in accounting period 12 or 13 will occur within the next two accounting periods.”

Article 7.1.B.3.b provides that any District or installation that exceeds the casual cap in more than one accounting period during a fiscal year (other than accounting periods 3 and 4) “will be required to settle the violation through monetary resolution that shall be calculated by utilizing the Level 5, Step A, straight time rate.” (After Feb. 16, 2008, compensation will be paid at Level 6, Step A.)
