Award on Applicability of TCOLA to Promotion Pay Anomaly Payments [pdf]

This is an NALC case in which the APWU intervened. The issue was whether the Postal Service's failure to pay Territorial COLA (TCOLA) as part of the promotion pay anomaly payments due under the June 13, 1990 Memorandum of Settlement of case number H7C-NAC-39 was a violation of that settlement. Arbitrator Das ruled that ongoing anomaly or ABC lump-sum payments made in accordance with that agreement include TCOLA. Please note that the APWU and the Postal Service agreed to changes in the National Agreement in 1999 that eliminated the pay anomaly for APWU bargaining unit employees.
